Stop "the selling off" of the lands of "Comunidades Campesinas" in Peru
The legislative decree 1015, approved on May 20th, 2008, by the President of Peru Alan Garcia, states that the private sales and investments on the lands of native people and rural communities allowed by a vote of the simple majority (the half of the members plus one voice) of members of the communal assemblies. By the end of June, the government face to the reaction of rural organizations, native people, public and international opinion modifies this legislative decree. The government decide that for the communal lands sales it’s necessary the half plus one voice of all the rural communities members (LD 1073). Those decrees modify the law 26 505 which demanded, as a prerequisite condition, the vote of 66.6 % of the qualified members of each community for the sale of the communal lands.
Alan Garcia decided to act without the agreement of the Parliament, and against Article 89 of the Constitution which states that their communal lands are imprescriptibly, inalienable, and indiscernible. This also goes against international conventions on the rights of native people which was signed by Peru. Such as the Declaration of the United Nations on the rights of the native people which, in Article 8, condemns “Any act having for goal or effect to deprive them of their lands, territories or resources” or Convention 169 of the IOT which imposes on the governments to consult the native populations on legislative or administrative measures which can affect them.
More than seven thousand communities and hundreds of thousands families of Andes and Amazonia are threatened by this measure which, as AIDESEP (interethnic Association for the Development of the Peruvian Forest)underlined, puts in danger the communal properties by risking to see the comunidades or a native population disappear. The communal lands in Peru are the material foundations of the life of the "Comunidades Campesinas", ancestral institution, expression of social, economic, cultural identity of the native people, where life gets organized on the basis of a democratic system of social justice, as well as on traditional way of collective work (minga, ayni).
This new legislation corresponds to the strategy of the government which opposes the traditional management of the collective lands by the native people of Peru and favours the exploitation of large areas of the Amazonian, still untouched. The government discourages social protest and political activity of ONG and trade unions. These are considered as the main obstacles to economic and social development in Peru. Alan Garcia has promised to fight against tradition so that the country could definitely enter into modernity. Peru, a country rich in natural resources (mines, fishing, arable lands, Amazonian forest) located mostly on communal lands has become the “El Dorado” of the multinational companies. Corruption among the communal leaders is rife as their support is bought by the companies expecting to profit from the Peruvian resources.
This causes violent confrontations between the “comuneros” and the companies. The “comuneros” condemn the pollution, the monopolizing and privatisation of their lands as well as the water resources by the companies; they have to endure serious threats to public health.
This new situation will result in a strong social instability, giving way to internal divisions and conflicts between the “comuneros.”
We therefore ask to the government of Alan Garcia:
- To abolish the Decree 1015and the Decree 1073,
- To guarantee the human rights of the “Comunidades Campesinas”, their democratic and social organisations, these are among the poorest members of the Peruvian people.
- To reorganise the economy of Peru by moving away from the neo liberal model of the government. This model favours private investment which is not able to create sustainable economic grow together with social equity. This model does not finish with poverty but increases it. We also ask to the government to assume its share of responsibility in the serious environmental problems of our planet.
We support the demands of the Confederacion Campesina del Peru (CPC), Confederacion Nacional Agraria (CNA), the National Confederation of the Communities affected by mining industries in Peru (CONACAMI), la Coordinación Andina de organizaciones Indigenas (CAOI), la Asociación Interétnica para el Desarrollo de la Selva del Peru (AIDESEP), la Central Unica Nacional de Rondas Campesinas and the several regional movements (Loreto, Madre of Dios, Puno, Cuzco, Apurimac, Ancash and others which also demand the abolition of the Decree.
